2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 363 and 366A of the Indian Penal Code.
3. As per the prosecution case, this petitioner along with co-accused Sher Singh kidnapped minor daughter of the informant.
4. Learned counsel appearing for the petitioner submits that at the time of alleged occurrence, age of victim was 17 years. Co-accused Sher Singh and the victim were in love affair and due to some money dispute, marriage was not performed between them and in this condition, victim implicated the petitioner and said co-accused in this false and

5. Learned counsel for the State and the informant oppose the prayer for bail. Learned counsel for the informant submits that the victim, in her statement recorded under section 164 of the Code of Criminal Procedure, has supported the prosecution case to the extent that petitioner and co-accused Sher Singh took her to Nepal and different states of the Uttar Pradesh and kept her in a room for months and committed rape on her. Court has assessed her age to be 13 years.
6. Considering the age of the victim and her aforesaid statement, prayer for bail of the petitioner is rejected. (Prabhat Kumar Singh, J) shashi/- U T
