The petitioner has been arrested in connection with Complaint Case No. 772 of 2013 which was further instituted as Kanti P.S. Case No. 316 of 2013 registered under Sections 302/120B of the Indian Penal Code.

The occurrence alleged to be taken place on 28.04.2013 and complaint was filed on 12.09.2013.

Learned counsel for the complaint however, submits that a conspiracy has been made to kill the victim by dashing with Bolero, so it is a case of conspiracy to kill the victim. Learned counsel for the petitioner submits that occurrence took place on 28.04.2013 but complaint filed on 28.05.2013,

No.20145 of 2015 (3) dt.31-07-2015 though, as per allegation post mortem of the deceased was conducted and even police came at P.O. on information on the date of occurrence but no F.I.R. lodged and there is land dispute and submission that allegations are cooked up at subsequent stage as there is land dispute.

Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the SubDivisional Judicial Magistrate, Muzaffarpur, in connection with Complaint Case No. 772 of 2013 which was further instituted as Kanti P.S. Case no. 316 of 2013.
