2. The petitioner seeks bail in connection with Paharpur P.S. Case No. 292 of 2025 registered for the offence under Sections 80, 61(2), 3(5) of the BNS.

3. As per the prosecution case, the petitioner is said to have killed his wife.

4. The petitioner is in custody since 9.6.2025.

5. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case. He further submits that the wife of the petitioner was ill and on the way to hospital, she died and the same fact has been supported by a co-villager, who has said that the petitioner has asked him for help to take his wife to hospital and he also

Patna High Court CR. MISC. No.2989 of 2026(3) dt.25-03-2026 2/2 accompanied the petitioner while he was going to hospital but on the way to hospital, the deceased died. Similarly, one Sipahi Singh has also given the same statement.

6. Considering the aforesaid facts, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-IX, East Champaran, Motihari/concerned Court below in connection with Paharpur P.S. Case No. 292 of 2025.
