2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) of Bihar Prohibition and Excise Act 2016 .

3 . It is alleged that 20 liters of country made wine and 1400 kg Jawa was recovered from the spot.

4. It is submitted that the petitioner is innocent and has falsely been implicated in this case only on the basis of suspicion . No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery . Petitioner has got one criminal antecedent of similar nature in which he is on bail.

6. Considering the facts of the case , in the event of arrest/surrender within eight weeks from today , let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Court No. 2 East Champaran at Motihari in connection with Excise Police Station Case No. 386 of 2019 , subject to the conditions laid down under section of 438(2) of the Code of Criminal Procedure .
