The dead body of the deceased was found on a railway track and after that UD case was registered. After post mortem dead body was handed over to the petitioner and his family members and thereafter, cremation was done. Before cremation of the deceased, coaccused Dashrath Yadav, who happens to be father of the petitioner, gave information to the informant and having got the aforesaid information, informant came and participated in the aforesaid cremation and after seven days of the occurrence, he filed a complaint case which was converted into police case.

No doubt, petitioner is husband of the deceased and marriage of the deceased had taken place three years ago and after completion of investigation, police submitted charge sheet under section 304B/34 of the Indian Penal Code but taking the above stated

Patna High Court Cr.Misc. No.4392 of 2015 (3) dt.24-04-2015 specific feature of the case, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara in Bihiya P.S.
