2. The petitioner apprehends his arrest in connection with Begusarai Excise P.S. Case No. 427/2024, a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, total 23.500 litres of illicit liquor was recovered from Baranda of the house.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner has got one criminal antecedent of similar nature in which he is on bail.

5. Learned counsel for the State has opposed the prayer for bail of the petitioner and submits that petitioner is

No.4916 of 2025(2) dt.13-02-2025 2/2 involved in the business of illicit liquor and no recovery has been made from the house of petitioner in view of Full Bench decision of this Court rendered in the case of Ram Vinay Yadav vs. The State of Bihar reported in 2019(2) P.L.J.R. 1089 (F.B.)

6. Considering the aforesaid fact of the case and also petitioner has one criminal antecedent of similar nature, this prearrest bail petition is dismissed. (Prabhat Kumar Singh, J) Ranjeet/- U T
