CORAM:
HONOURABLE MR.
JUSTICE CHAKRADHARI SHARAN SINGH ORAL JUDGMENT & ORDER Date: 03-01-2018 Heard the parties.
2. The petitioner claims that he had passed intermediate examination, held by the erstwhile Bihar State Intermediate Council, in the year 1992. It is his case that
Patna High Court CWJC No.4434 of 2017 dt.03-01-2018 2/3 though other documents/certificates of having passed the said examination, including the marks sheet, had been given to him, the original certificate was not made available to him.
3. Learned counsel, appearing on behalf of the petitioner, has submitted that the petitioner is now in dire need of the original certificate for the purpose of his employment etc. It is the further case of the petitioner that he has applied for making available the original certificate of having passed said intermediate examination before the Bihar School Examination Board (in short 'the BSEB'), which is the successor body of the Bihar State Intermediate Council, through representation submitted on 16.01.2017.
4. Considering the facts and circumstances of the case, I dispose of this writ application with a direction to the BSEB to consider the petitioner's case for grant of original certificate and if the original certificate is found not to have been issued, the same must be made available to the petitioner on satisfaction that he had passed the said intermediate examination.
5. It is made clear that the petitioner shall be at liberty to apply for duplicate of original certificate of having passed the said intermediate examination, which shall be issued by the BSEB in accordance with law, within a period of one month from the date of making of the application, if the
Patna High Court CWJC No.4434 of 2017 dt.03-01-2018 3/3 specified fee is deposited by the petitioner in this regard, expeditiously.
6.
With the aforesaid observation, this application stands disposed of.
