1. Heard learned counsel for the petitioner and learned counsel for the respondent-State.

2. After some arguments, learned counsel for the petitioner submits that 12 months has almost lapsed even if the date of suspension is taken to be with effect from 19.09.2022 under resolution No. 1304 issued by the Department. He submits that he would be availing remedies under Rule 10 of the

Patna High Court CWJC No.1903 of 2023(6) dt.24-08-2023 2/2 Bihar Government Servants (Classification, Control & Appeal) Rules, 2005.

3. The submission is without prejudice to pendency of M.J.C. No. 1234 of 2022 earlier filed by the petitioner alleging violation of the court's order passed in his earlier writ proceedings arising out of C.W.J.C. No. 15551 of 2016.
