2. Following relief(s) have been prayed for in paragraph no. 1 of the present writ application. "That this is an application for issuance of an appropriate writ(s), order(s), direction(s) for quashing the order contained in memo no. 53 dated 19.01.2016 as well as the order dated 22.01.2016 whereby and whereunder the respondent Sub-Divisional Officer recommended to the Addl. Collector to cancel the Jamabandi case on the basis of the report of the circle officer as well as the officer In-charge and the Addl. Collector accordingly re open the case and issue notices to the parties on 22.01.2016 without considering the order dated 01.09.2015 passed in Land Dispute Solutions case No. 03 of 2015-16 by the Deputy Collector of land Reforms, Madhubani and to grant any other

3. At the outset, learned counsel for the respondentState submits that order dated 22.01.2016 passed in Case No. 24 of 2015-16 is not a final order. Learned counsel contends that by the said order, only notices have been issued to the parties. Learned counsel further submitted that petitioner should appear before the concerned authority and respond to the notices. Therefore, the present application is premature.
4. Learned counsel for the petitioner, therefore, seeks permission of the Court to withdraw the present application with liberty to file a fresh application, if occasion arises.
5. With the aforesaid liberty, the writ application application stands dismissed as withdrawn.
