This application for anticipatory bail arises out of Muffasil P.S. Case No. 489 of 2018 for the offence under Sections 341, 342, 323, 324, 504, 307 and 354 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that there is allegation against co-accused Jacchan Singh of having made an attempt to outrage the modesty of the informant. The said Jacchan Singh has been described as brother of the father-in-law of the informant. Allegedly, there was scuffle over the incident between the said Jacchan Singh and the informant's son, who had come in rescue. Jacchan Singh is said to have assaulted the informant's son. The petitioner is said to have come in the meanwhile and assaulted the informant's son.

No.3659 of 2019(2) dt.25-01-2019 2/2 Learned counsel appearing on behalf of the petitioner has submitted that so far as this petitioner is concerned, it is evident from the First Information Report that he had come after the incident had already taken place and he had just interceded in the scuffle between the two. Considering the nature of accusation against this petitioner, this application is allowed.

Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Begusarai in Muffasil P.S. Case No. 489 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
