====================================================== CORAM: HONOURABLE MR. JUSTICE KHATIM REZA ORAL ORDER 06-06-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners seek regular bail in connection with Kangli P.S. Case No. 104 of 2020 instituted for the offences under Sections 302 and 34 of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioners are in custody since 14.08.2021, are persons with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioners submits that the allegation is that sister of the informant has been killed by the accused persons. The marriage of the deceased was solemnized with accused, Umesh Pandey about 8 to 9 years ago. It has further been submitted that sister-in-law of the petitioners died in the
Patna High Court CR. MISC. No.4242 of 2022(2) dt.06-06-2022 2/2 matrimonial house and allegation is that she was done to death by the petitioners and other family members. The marriage of the deceased was solemnized with accused Umesh Pandey. Out of this wedlock, three children have been born and presently these children are with their grandfather. The husband of the deceased is already in jail in connection with Kangli P.S. Case No. 104 of 2020. It is further submitted by the learned counsel for the petitioners that both the petitioners separately resided and separate in mess from the husband of the deceased.
Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioners.
Considering the fact that the petitioners are in custody since 14.08.2021, charge-sheet has been submitted in the case and the petitioners are persons with clean antecedent, let the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Kangli P.S. Case No. 104 of 2020.
