1. Heard learned counsel for the parties.

The instant case has been filed by the petitioner, who claims himself to be a representative of the weaker section of the society, praying for a direction to the respondent authorities to enquire into the matter and take appropriate action against the mukhiya of Gram Panchayat Raj Bari under Singhiya Block in District- Samastipur. Further prayer is made for getting an

Patna High Court CWJC No.1387 of 2023 dt.14-07-2023 2/3 enquiry conducted into misappropriation of fund by the officers in completing the Government scheme under the 'Prime Minister Awas Yojna' ('the scheme' in short).

Having heard learned counsel for the parties and having gone through the material on record including the counter affidavit filed on behalf of the respondent-Collector, Samastipur, the Sub-Divisional Officer, Rosera and the Block Development Officer, Singhiya, it transpires that so far as the list of beneficiaries under the scheme is concerned, the selection list is shown on the website through the Department of Rural Development. The BDO, Singhiya vide memo dated 27.1.2022 constituted a team of seven persons to enquire into the matter and on enquiry the Committee submitted a report over which the petitioner has also put his signature.

4. It has further been stated in the counter affidavit that there is dispute between the petitioner and the mukhiya concerned. Further the petitioner has not brought on record any material to substantiate his bald allegations of misappropriation of fund meant for the scheme by the authorities.

5. Having heard learned counsel for the parties and having gone through the contents of the counter affidavit according to which an enquiry was already conducted so far as

6. The writ application stands disposed of.
