1. Heard learned counsel for the petitioner and the learned APP for the State.

2. Petitioner seeks regular bail in connection with Lalganj P.S. Case No. 57 of 2018 dated 27.02.2018 registered for the offence(s) punishable under Section 394 of the Indian Penal Code.

3. The main submissions advanced by the learned counsel for the petitioner are that the petitioner has not been named in the FIR, his name surfaced in the confessional statement of co-accused Guddu Alam, who has been granted bail by the trial court itself and another co-accused namely Vikram Mahto has been granted bail by a co-ordinate bench of this court vide order passed in Cri. Mis. No. 84157 of 2023. Further submissions are that the informant claimed to be able to

No.7805 of 2024(2) dt.19-02-2024 2/2 identify the accused persons but even then the petitioner was not put on test identification parade after his arrest, though against him there are criminal antecedents of three cases but he has been acquitted in one case and in rest two cases, he is on bail and after his arrest, the police failed to recover any incriminating martial or looted article from his possession and he has been languishing in jail since 17.04.2023 and against him, investigation has been completed in the present matter.

4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.

5. Considering the above submissions, this court is inclined to accept petitioner's bail prayer. Accordingly, let the petitioner named-above be enlarged on bail in connection with Lalganj P.S. Case No. 57 of 2018 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned. (Shailendra Singh, J) Rajiv/- U T
