The present petition has been filed seeking restoration of a writ petition bearing CWJC No. 1599 of 2018, which has stood dismissed on account of non-compliance of the peremptory order dated 30.1.2018.

It has been stated in the present petition that the counsel for the petitioner could not appear before this Court on the day on which the aforesaid

Patna High Court MJC No.4444 of 2018(3) dt.30-11-2022 2/2 writ petition was taken up for hearing, hence, could not remove the defects within the peremptory time, however, it is averred that the petitioner would definitely remove the defects, as pointed out by the registry in the aforesaid writ petition bearing CWJC No. 1599 of 2018.

Having regard to the averments made in the present petition, I deem it fit and proper to restore the aforesaid writ petition bearing CWJC No. 1599 of 2018 to its original file, subject to removal of the defects, as pointed out by the registry, within a period of three weeks from today. It is made clear that in case, the defects are not removed within a period of three weeks from today, no further restoration petition shall be entertained.

The present petition stands disposed of on the aforesaid terms.
