The petitioner is in custody since 06.09.2018 in connection with Chandauti P.S. Case No. 117 of 2018 for the offence registered under Section 392, 387, 341, 342, 435, 120(B) of the Indian Penal Code.

Learned counsel for the petitioner submits that admittedly the FIR was lodged against unknown persons for ransom and threats having been given by some naxalite group. Learned counsel for the petitioner further submits that the petitioner has not being named in the FIR. His name surfaced only on the confessional co-accused Pramod Yadav which has no evidentiary value in the eye of law. It is further submitted

No.3237 of 2019(4) dt.28-02-2019 2/2 that save and except aforementioned confessional statement by Pramod Yadav there is no further cogent material available so as to implicate the petitioner in connection with the present case. Learned counsel for the petitioner submits that similarly situated co-accused persons have since been extended the privilege of regular bail vide order dated 29.10.2018 and 20.12.2018 passed in Cr. Misc. No. 64731 of 2018 and Cr. Misc. No. 76995 of 2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Chandauti P.S. Case No. 117 of 2018.
