JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 21-04-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Gardanibagh P.S. Case No. 355 of 2015, registered under Sections 406, 420, 467, 468 and 471 of the Indian Penal Code. The accusation is that Chunnu Singh and his two brother-in-laws, namely, Chandrasekhar Kumar and petitioner Sandeep Kumar used to reside in the rented house at Bhikhachak and Chunnu Singh made a proposal for establishing the ITI school for their livelihood and also for social upliftment from the informant. The informant accepted his proposal and paid Rs. 8,75,000/- to said Chunnu Singh, who assured to return the money in case of not establishing the ITI school. Thereafter,

Patna High Court Cr.Misc. No.13708 of 2016 (2) dt.21-04-2016 2/2 neither the ITI school was opened nor the money was returned to the informant. Subsequently, three cheques were issued, but the same were found dishonoured due to insufficiency of amount. Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that transaction of money took place in between the informant and co-accused Chunnu Singh and not by this petitioner. The petitioner being the brother in law of Chunnu Singh has falsely been implicated in this case. The petitioner having no criminal antecedent is in custody since 12.12.2015.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sri Manoj Kumar-V, Judicial Magistrate, 1st Class, Patna in connection with Gardanibagh P.S. Case No. 355 of 2015.
