Mandal, learned standing counsel no. 3 by referring to the averments made in the supplementary counter affidavit filed on behalf of respondent no. 4, submits at the bar that the petitioner who superannuated from his service on 28.02.2017 from the office of District Information and Public Relations Office, Aurangabad has filed the writ petition for payment of all his pensionary benefits alongwith the statutory interest.

2. During the pendency of the writ petition, the petitioner has already been paid his admissible retiral dues, including an amount of Rs. 4,42,890/- + 7,630/- against the unutilized leave. Further an amount of Rs. 2,09,823/- under the head of group insurance and Rs. 20,31,794/- under the head of

Patna High Court CWJC No.1445 of 2019(5) dt.04-12-2023 2/2 G.P.F. have been paid.

3. He next submits that an amount of provisional pension with effect from March, 2017 to September, 2019 amounting to Rs. 6,55,762/- has also been paid to the petitioner.

He next submits that pursuant to the direction of this Court, the service book of the petitioner was re-constructed and the same has been send to the office of Accountant General, Bihar, Patna vide letter no. 104 dated 19.10.2022 and accordingly the pension of the petitioner has now been fixed. Under such circumstances it is manifest that the entire retiral dues found payable has been paid to the petitioner.

5. Considering the averments made in the supplementary counter affidavit filed on behalf of respondent no. 4, prima facie showing the payment of all the retiral benefits, the present writ petition stands disposed off.

6. Needless to observe that in case the petitioner is not satisfied with the payment of retiral benefits under any head, he shall be at liberty to file an appropriate representation before the concerned respondent for redressal of his grievance. (Harish Kumar, J) supratim/- U
