The petitioner seeks bail in connection with C2 Case No. 431 of 2021 instituted for the offences under Section 30(a) of the Bihar Excise Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 10.09.2021, is a person with clean antecedent and prosecution report has been submitted in the case.
Learned counsel for the petitioner submits that the allegation is of recovery of 63 litres of liquor from Nepal-India border.
Learned counsel for the petitioner submits that the

No.4535 of 2022(2) dt.07-03-2022 2/2 petitioner was a mere passerby and the real culprits, on seeing the police threw the liquor and fled and the petitioner came to be implicated when the search was made Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody, is a person with clean antecedent and prosecution report has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 3,000/- (Rupees Three Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cumSpecial, Judge, Excise, Sitamarhi in connection with C2 Case No. 431 of 2021.
