The petitioner seeks regular bail in Chenari P.S. Case No. 254/2017, registered for the offence punishable under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that petitioner is not named in the F.I.R. There is no recovery of any incriminating article from possession of this petitioner. No Test Identification Parade (TIP) has been held. Name of this petitioner has come in the confessional statement of co-accused Sunil Pandey who has been granted bail by Coordinate Bench of this court vide order dated 12.04.2018 passed in Cr. Misc. No. 13292/2018. Petitioner is in custody since 20.08.2018. Considering the facts and circumstances of the case,

Patna High Court Cr.Misc. No.3516 of 2019(2) dt.01-02-2019 2/2 prayer of the petitioner for grant of bail is allowed. Let the petitioner above-named, be released on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-cum-Sub Judge, Sasaram (Rohtas) in connection with Chenari P.S. Case No. 254/2017, subject to the condition that both the bailors will be close relative of the petitioner.
