JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-03-2019 In this case earlier prayer for bail of petitioner no.2 has already been rejected vide order dated 25.01.2019. This is an application for grant of anticipatory bail in connection with Bhabua P.S. Case No. 618 of 2018, disclosing offences under Sections 147, 148, 149, 341, 323, 324, 307 of the Indian Penal Code.

Allegation against rest of the petitioners i.e. petitioner nos.1, 3 and 4, is that they have assaulted the informant and others by bhala causing injury.

Submission of learned counsel for the remaining petitioners i.e. petitioner nos.1, 3 and 4, is that though there is

Patna High Court CR. MISC. No.3461 of 2019(5) dt.11-03-2019 2/2 allegation of assault by bhala and some injuries are grievous in nature, but that is on the teeth and hand and there is case and counter case between the parties also and petitioners' side also received injuries.

Heard learned A.P.P. as well as learned counsel for the informant, they have opposed the prayer for anticipatory bail of the petitioners.

Having heard both sides, considering the above submission, so far petitioner nos.1, 3 and 4 are concerned, this application is allowed. Let petitioner nos.1, 3 and 4, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Kaimur at Bhabua, in connection with Bhabua P.S. Case No. 618 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Amjad/- U T
