The petitioner seeks bail in connection with Special B.A. (Excise) No. 801 of 2021 arising out of Excise Case No. 76 C 3/2021 instituted for the offences under Section 30(a) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 10.09.2021, prosecution report has been submitted in the case and is a person with clean antecedent.

Learned counsel for the petitioner submits that the allegation is of recovery of 576 litres of liquor from a Bolero. Learned counsel for the petitioner submits that the

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent and prosecution report has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 3,000/- (Rupees Three Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Khagaria in connection with Special B.A. (Excise) No. 801 of 2021 arising out of Excise Case No. 76 C 3/2021.
