The petitioners are apprehending arrest in connection with Chanauti P. S. Case No. 152 of 2019 for offences under Sections 341, 323,379, 385, 504 and 506/34 of the Indian Penal Code.

Allegation against the petitioners is that they have took way Rs. 18,000/- from the Cash Box on the point of pistol and demanded Rangdari.

Learned counsel for the petitioners submits that the petitioners have no criminal antecedent. There is case and counter case and also previous enmity. The present case is

Patna High Court CR. MISC. No.7149 of 2020(3) dt.29-02-2020 2/2 counter blast of Chanauti P.S. Case No. 151 of 2019 filed by the petitioner no.2 against the informant of the present case. Considering the fact that the petitioners have no criminal antecedent and also the fact that petitioner no. 2 has lodged a case against the informant of this case, the Court is inclined to grant bail to them. Let the petitioners, above named, in the event of arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in connection with Chanauti P. S. Case No. 152 of 2019, subject to the conditions as laid down under Section 438(2) Cr. P. C.
