JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 03-07-2019 In the instant writ petition preferred under Articles 226 and 227 of the Constitution of India, the petitioner has prayed for issuance of direction to the respondent authorities to take necessary action against private respondent nos.10 to 24 so that they may not disturb the peaceful possession over his Khatiani land as mentioned in paragraph no.4(i) of the writ petition.
It has been pleaded that the petitioner is in peaceful possession of the property as mentioned in paragraph no.4(i) of the writ petition. However, the private respondent nos.10 to 24 are disturbing his peaceful possession over the property and are adamant to grab his land by force.
In view of the availability of an equally efficacious statutory remedy under the Code of Civil Procedure, I am not inclined to entertain this application in extraordinary jurisdiction under Article 226 of the Constitution of India. The application is dismissed.
