The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 302, 201, 120B of the Indian Penal Code.

As per prosecution case, the allegation against the accused persons including the petitioner is that they committed murder of the informant's daughter due to nonfulfillment of dowry demand. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is husband of the deceased and their marriage was solemnized in 2007 and they were blessed with two children rather he has falsely been implicated in this case.

As per statement of two children of the deceased which is mentioned at Paras- 44 and 45 of the case diary wherein they have stated that her mother died due to illness and other witnesses also not stated about the complicity of the petitioner in this alleged occurrence. It is further submitted that the petitioner is languishing in judicial custody since 21.04.2022. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Rafiganj P.S. Case No. 291 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, Bihar.
