Petitioner is in jail custody since 12.1.2016 in a case registered under sections 419 and 420 of the Indian Penal Code. The accusation against the petitioner is that he took entire ornaments of the informant by playing fraud upon her but admittedly, nothing has been recovered from possession of the petitioner nor the petitioner does have any criminal antecedent. The contention on behalf of the petitioner is that, as a matter of fact, petitioner, himself, had mortgaged the ornaments of his wife with the informant and when he demanded the ornaments, informant lodged this false case.
Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of the period of detention of the petitioner in jail custody, let the petitioner be released
