Heard the parties in virtual Court.

The petitioner is languishing in custody for the offence punishable under Sections 363/366A/34 of the Indian Penal Code.

The victim in her statement under Section 164 Cr.P.C. alleges that she was forcefully kidnapped by the petitioner and others. However she is specific that no misbehaviour took place with her.

Submission is that the matter appears to be of some previous affairs and the victim has suppressed the real fact. Learned counsel for the informant submits that

Patna High Court CR. MISC. No.14347 of 2021(2) dt.08-07-2021 2/2 kidnapping of a minor for wrongful confinement is punishable for seven years and the offence is non-bailable. Petitioner is in custody since 18.12.2020.

Considering the statement of the victim girl under Section 164 Cr.P.C. and completion of investigation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Barhaia P.S. Case No. 6 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
