The petitioner seeks bail in a case registered under Sections 304(B), 201/34 of the Indian Penal Code. The petitioner is the husband of the deceased. The father of the deceased made allegation that after marriage, the petitioner and other family members of the petitioner were subjecting his daughter to different sorts of torture and she was killed on 01.03.2013 and her dead body was disposed of. It is submitted that the petitioner is working in Ludhiana. During the course of investigation, many witnesses have stated that the petitioner was not even present at the place of occurrence. Having considered the fact that the informant and others have made very specific allegation that the petitioner being the husband was torturing his wife and killed her and disposed of
Patna High Court Cr.Misc. No.21104 of 2015 (3) dt.04-09-2015 2/2 her dead body, I am not inclined to enlarge the petitioner on bail in Islampur P.S. Case No. 43 of 2013, corresponding to S.T. No. 608/2013 / T.R. No. 58/2014.
Accordingly, the same is rejected.
The trial court is directed to expedite the trial and conclude the same within nine months from the date of receipt/production of copy of this order. If the trial is not concluded within the aforesaid period, the petitioner may renew his prayer for bail.
