Petitioners are named in the first information report and it is stated that informant was assaulted by co-accused Suresh Paswan whereas petitioner no.2 is said to have assaulted informant's son by means of lathi.
So far as petitioner no.1 is concerned, it is not clear from written report as to whom, petitioner no.1 assaulted. When further statement of the informant was recorded at para 2 of the case diary, he, specifically, stated that petitioner no.1 assaulted his wife. Further statement of the informant reflects that the petitioners did not even touch informant who later on died.
Accordingly, petitioners are directed to be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the
Patna High Court Cr.Misc. No.4796 of 2015 (3) dt.24-04-2015 like amount each to the satisfaction of the Chief Judicial Magistrate, Munger in Kharagpur P.S. Case no. 291/2013.
