Mr.Md. Iftekhar Mahmood ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-02-2019 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.

The petitioner is in custody in connection with Case No. 71C2 of 2018 for the offence under Section 30 (a), 32 and 41 of Bihar Prohibition and Excise (Amendment) Act 2018. Learned counsel appearing on behalf of the petitioner submits that petitioner has no criminal antecedent. He further submits that in the instant case total 210 liters country made liquor was seized. Learned counsel for the petitioner next contended that nothing has been recovered from the conscious possession of the petitioner. He further submits that petitioner is not involved in trade of liquor. He submits that petitioner is in custody since 30.9.2018.

No.9923 of 2019(2) dt.19-02-2019 2/2 Considering the fact that the petitioner has no criminal antecedent and he has remained in custody nearly four months, the Court is inclined to grant bail to the petitioner, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Court of learned 2nd Additional District & Sessions Judge-cum-Special-Judge, Excise, Act, Lakhisarai, in connection with Excise Case No. 71C2 of 2018.
