2. The petitioner apprehends her arrest in a case registered for the offence under Sections 448, 341, 323, 324, 307, 380, 354(B), 504/34 of the Indian Penal Code.
3. The informant narely, Babita Devi alleged that on 18-6-2024, while she was at home, then all the accused persons, named in the F.I.R. including petitioner, arrived there, abused and assaulted her. It is further alleged that co-accused, Suman, Shankar and Prakash dragged her by hair and disrobed her and attempted to molest her and when her father-in-law and daughter intervened, they were also attacked. This petitioner (Sarita Devi) alongwith co-accused Umda Devi snatched gold chain worth Rs 40,000 from the neck of informant. It is next alleged that on 20.6.2024, husband and brother-in-law of informant were assaulted with farsa by co-accused Suman Mali
Patna High Court CR. MISC. No.5520 of 2025(2) dt.25-02-2025 2/2 and Shankar Mali, causing serious injuries to them. The attack was allegedly instigated by co-accused Jagannath Mali, who threatened to kill informant's family.
4. Learned counsel for the petitioner submits that allegation of assault is general and omnibus and there is no specific allegation of overt act against this petitioner. Case and counter case. Petitioner is lady and has got clean antecedent.
5. Learned A.P.P. for the State has opposes the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - I, Jhanjharpur, District Madhubani in connection with Jhanjharpur P.S. Case No. 106 of 2024 (G.R. No. 942/2024), subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay U T
