The petitioner seeks bail in a case under Section 420 and other sections of the Indian Penal Code and Section 7 of the Essential Commodities Act.

The police intercepted a truck bearing registration No. JH-02P 0339 from which 229 quintals and 60 Kg. grains was recovered. It is alleged that the petitioner is the driver of the truck and one Amar Shukla is the owner of the truck. The accused persons were carrying the food-grains from the FCI godown.

Patna High Court Cr.Misc. No.20738 of 2015 (2) dt.17-06-2015 2/2 already been enlarged on anticipatory bail vide order passed in Cr. Misc. No. 5396 of 2015. Lalan Bhagat and Manoj Kumar Yadav have also been enlarged on bail. The petitioner is in jail since 12.3.2015.

Considering the nature of allegation and the fact that the petitioner has already remained in jail for more than three months, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No. 742 of 2014.
