JUSTICE SUDHIR SINGH ORAL ORDER 16-07-2015 The petitioner is languishing in custody since 11.12.2014 in connection with Bochaha P.S. Case No. 325 of 2014 for the offences instituted under Sections 399, 402, 414 of the I.P.C. and 25(1-b) A, 26(ii) and 35 of the Arms Act Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that the informant who on tip off regarding commission of bank dacoity and in order to nab the criminal he organized a police team of the officer-incharge of several police stations and threw a dragnet around the Bank. At around 3.00 P.M. six persons born on three Bike came and parked their Bike at few distance from the Bank. They have bag and were consulting and deliberating with each other, in the

A loaded country made pistol recovered from possession of the petitioner. A mobile was also recovered from possession of petitioner. Accordingly, a seizure list was prepared in presence of two independent witnesses and copy of the same was handed over to all accused persons.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.12.2014 and the charge sheet has been submitted in the present case. It is further submitted that from possession of the petitioner, one country made pistol and live cartridge are said to have been recovered from possession of the petitioner.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Muzaffarpur, in connection with Bochaha P.S. Case No. 325 of 2014.
