JUSTICE AMARESH KUMAR LAL ORAL ORDER 24-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner seeks bail in a case registered for the offence punishable under Sections 420, 354, 323, 504 and 506 of the Indian Penal Code as well as Section 3(1)(x) of the S.C./S.T. Act.
The allegation is that the petitioner transferred a land by registered sale deed to the informant but did not deliver the possession of the land nor did he refund Rs. 92,000/-, the value of the land.
It is submitted that the petitioner transferred the land on the payment of Rs. 20,000/- only and Rs. 72,000/- was due with the informant and when he demanded money, he has refused. Thereafter the petitioner has asked the informant to
Patna High Court Cr.Misc. No.10102 of 2015 (2) dt.24-04-2015 2 / 2 vacate the possession of the land. The petitioner has been in custody since 17.11.2014 and the petitioner has no criminal antecedent.
Considering the facts and circumstances, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui/court concerned in connection with Sikandra P.S. Case No. 253 of 2013 with following conditions:-
(1) The petitioner will not indulge himself in similar or any other offence.
(2) One of the bailors must be the close relative of the petitioner.
(3) The petitioner will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, his bail bond would be liable to be cancelled by the learned Court concerned.
