JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-07-2022 The present writ petition has been filed for directing the respondents to remove the encroachment made over R.S. Khata no. 117, R.S. Plot no. 305 measuring an area of 10.18 decimals lands situated in Mauza-Siswar, PS-Karamchat (Sabar), District-Kaimur at Bhabua, which is a public land.

Patna High Court CWJC No.22583 of 2018(2) dt.20-07-2022 2/2 At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Rampur (Belaon) Block, Kaimur at Bhabua i.e. the respondent no. 4 by filing appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956. The learned counsel for the respondent- State submits that in case, the petitioner approaches the respondent no. 4, definitely appropriate orders shall be passed, in accordance with law.

Having regard to the facts and circumstances of the case, the present writ petition stands disposed off, however with a liberty to the petitioner to approach the respondent no. 4 by filing appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956 and in case, such a petition is filed within a period of four weeks from today, the respondent no. 4 shall take appropriate action, in accordance with law, after hearing the affected parties and passed appropriate order, within a period of 12 weeks, thereafter.
