30-06-2021 Heard learned counsel for the parties through video conferencing.
The petitioner seeks bail in Gopalpur P.S. Case No. 180 of 2020, registered for the offence under Section 379 of the I.P.C. and later on, Section 411 of the I.P.C. was added. As per the prosecution case, some unknown miscreants committed theft of the motorcycle of the informant. It is submitted on behalf of petitioner that petitioner is not named in the FIR. However, since petitioner has got criminal antecedent and he is accused in two more cases i.e. Didarganj P.S.Case No. 252 of 2019 and Gopalpur P.S. Case No. 179 of 2020, he has been remanded in the present case and on the basis of his self-confessional statement, he has been made accused in the present case. Till date, petitioner has not been put on T.I.P. and he is in custody since 02.09.2020.

No.13861 of 2021(2) dt.30-06-2021 2/2 However, learned A.P.P. for the State vehemently opposed the bail petition and submitted that on the confessional statement of this petitioner, the stolen motorcycle of informant has been recovered from the possession of this petitioner. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner and same is, accordingly, rejected.
