The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 341, 386, 387, 506 of the Indian Penal Code.

The prosecution case in nutshell is that when the informant was at his house, petitioner along with two other persons came and when the informant explained him to stop misleading facts which is being propagate against him on social media, petitioner demanded Rs. 50,000/-(fifty thousand rupees) per month to stop such

Patna High Court CR. MISC. No.6954 of 2023(2) dt.12-04-2023 2/3 things. It is further alleged that when the informant showed incapacity, petitioner snatched Rs. 17,472/- from the pocket of informant and threatened to manage remaining amount.

It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. There is inordinate delay of 15 days in lodging the F.I.R. It is further submitted that on the alleged date of occurrence, petitioner was not present at the place of occurrence. Due to his criminal antecedents, petitioner has been dragged in this case with false and concocted allegations. Demand of ransom has not been executed. Moreover, the petitioner is languishing in judicial custody since 08.09.2022.

Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and

The above named petitioner is directed to be enlarged on bail in connection with Nabinagar P.S. Case No. 330 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., 1st, Aurangabad.
