JUSTICE ASHUTOSH KUMAR ORAL JUDGMENT Date : 07-02-2019 Heard the counsel for the petitioner and the State. The petitioner has approached this Court for a direction to the respondent State for appointing the petitioner on any commensurate post as he has cleared the examination conducted by Bihar Staff Selection Commission for the 2nd Graduate Level Competitive Exam.

It appears that pursuant to the advertisement no. 07070114, the petitioner had applied and appeared in the examination in which he was declared successful and was placed at serial no. 104.

Patna High Court CWJC No.2128 of 2019 dt.07-02-2019 2/3 It is the case of the petitioner that persons placed below in the merit ranking have been offered appointment on various posts whereas the claim of the petitioner has been ignored. The petitioner has apprehension that may be becasue of his disclosure of being involved in a criminal case, his candidature has been by-passed. However, no such communication has been made to him in that regard. A representation has been made by the petitioner before the Secretary, SC/ST Welfare Department, Bihar, Patna but the aforesaid representation has not been responded to.

Under the aforesaid circumstances, the petitioner is directed to make a fresh representation before the Secretary, Scheduled Castes and Scheduled Tribes Welfare Department, Bihar, Patna, detailing his grievances and the explanation which he has for his involvement in the criminal case, within a period of two weeks from today. On receipt of such representation, the Secretary, SC/ST, Welfare Department Bihar, Patna after verifying all the records shall pass a reasoned order within a period of eight weeks thereafter.
