The petitioner seeks regular bail in connection with Special Case No.11 of 2019 arisig out of Saharsa Sadar P.S.Case No.923 of 2019 dated 14.10.2019 registered for offences punishable under Sections 401, 413, 414 of the Indian Penal Code and Section 20, 22, 22(B) of the N.D.P.S. Act. Police apprehended two accused persons including the petitioner and from the other accused persons there is recovery of 400 grams of Ganja and mobile and from this petitioner there is recovery of power causing irritation on throwing on anybody as well as mobile.

Submission of the learned counsel for the petitioner is that petitioner has no criminal antecedent and he is in custody

Patna High Court CR. MISC. No.2118 of 2020(2) dt.16-01-2020 2/2 for three months. Charge sheet has already been submitted and there is no recovery of Ganja from him .

Heard learned A.P.P. also.

Having heard both sides and in view of submissions as made above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge cum Special Judge, Saharsa in connection with Special Case No.11 of 2019 arising out of Saharsa Sadar P.S.Case No.923 of 2019.

With the above direction, this application is allowed.
