JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 272 and 273/34 of the Indian Penal Code as well as Section 47(A) of the Excise Act.

Taking into consideration that in huge quantity country made liquor as well as other apparatus of manufacturing country made liquor were recovered from the house of the petitioner, who does have criminal antecedent of similar nature, now I am not inclined to release the petitioner on bail at least at this stage and, accordingly, his prayer for bail in connection with Madhuban P.S. Case No.351 of 2015 pending in the court of

Patna High Court Cr.Misc. No.11830 of 2016 (2) dt.17-03-2016 2/2 Additional Chief Judicial Magistrate-IV, Motihari stands rejected. However, if the trial of the petitioner is not concluded within four months from the date of receipt/production of a copy of this order, petitioner may renew his prayer for bail before the court below itself.
