The petitioners seek bail in Bahadurpur P.S. Case No. 423 of 2018 giving rise to G.O. Case No. 852 of 2018, instituted for the offence under Section(s) 272, 273, 420, 467, 120(B) of Indian Penal Code, Sections 30(a), 32(2), 33, 36 and 41(1) of Bihar Prohibition & Excise Act, 2016 pending in the court of learned Additional Sessions Judge-IVth-cum-Special Judge, Darbhanga.
It is alleged in the written report that police apprehended one pick-up van which was being driven by petitioner No. 1. Petitioner No. 2 was found sitting in the
Patna High Court Cr.Misc. No.4478 of 2019(3) dt.08-02-2019 2/2 vehicle. Police made search and found 2280 bottles, each containing 375 ml. of foreign liquor kept hidden behind straw. Petitioner could not give any valid answer with regard to aforesaid liquor.
Keeping in view the recovery of huge quantity of foreign liquor from the vehicle which was being driven by the petitioner No. 1 and petitioner No. 2 was found sitting, this Court is not inclined to grant bail to the petitioners at this stage. Prayer of the petitioners for grant of bail stands rejected.
Petitioners may renew their prayer for bail after completion of six months in custody.
