2. The petitioner seeks regular bail in connection with Bihta P.S. Case No. 700 of 2023, lodged on 10.07.2023 under Sections 302, 34 of the Indian Penal Code read with section 27 of the Arms Act.

3. As per the prosecution case, FIR has been lodged against two named accused and four unknown accused persons.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel also submits that the petitioner is not named in the FIR and from the contents of FIR, it is clear that the informant has disclosed the two named accused persons in the involvement of the killing of the informant's father. Counsel further submits that during

No.9345 of 2024(2) dt.20-02-2024 2/2 investigation, the police has arrested the petitioner only on the ground that the petitioner's wife used to talk with the deceased on mobile phone and only due to this reason, the petitioner has been apprehended by the police on suspicion.

5. Learned counsel for the petitioner submits that the charge-sheet has already been filed in this case. Counsel further submits that antecedent of the petitioner is clean and he is in custody since 19.07.2023.

6. Learned APP for the State opposes the prayer for bail of the petitioner.

7. In the present facts and circumstances of this case and the submissions made above considering the antecedent of the petitioner, let the petitioner above named be granted bail, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Danapur, Patna in connection with Bihta P.S. Case No. 700 of 2023, subject to the conditions as laid down U/s 437(3) Cr.P.C. (Dr. Anshuman, J.) Divyansh/- U T
