====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-05-2023 Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in a case registered for the offences punishable under Sections 323, 380, 420, 304B/34 of the Indian Penal Code.

The prosecution case is based on a written report by the informant alleging therein that informant's sister Sarita Devi married with Ram Udit in the year 2011 and out of this wedlock, two children were born and after death of Sarita Devi he got married with Sanju Devi. In order to grab the property, all the accused persons killed the deceased by administering poison. Learned counsel appearing for the petitioner submits that complainant is brother-in-law and petitioner is second wife

Patna High Court CR. MISC. No.10895 of 2023(2) dt.15-05-2023 2/2 of the deceased. Petitioner is innocent and has falsely been implicated in this case only with a view to grab the property of the deceased. Neither the informant nor anyone else had seen the accused persons administering poison to the deceased. From the post-mortem report, it is apparent that no anti-mortem injury was found on the body of the deceased. Petitioner is a lady and has got clean antecedent.

Considering the aforesaid facts and circumstances, this anticipatory bail is allowed and it is ordered that the above named petitioner in the event of her arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VI, Patna City in connection with Gaurichak P. S. Case No. 108 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
