JUSTICE ASHUTOSH KUMAR ORAL ORDER 06-01-2022 Heard Mr. Kuldeep Kumar, learned Advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Triveniganj P.S. Case No. 106 of 2020 dated 06.05.2020 instituted for the offences under Sections 147, 149, 341, 323, 325, 308, 379 and 504 of the Indian Penal Code.
The accusation against the petitioner and others is of assaulting the informant and his nephew and another. There is a counter version of the occurrence lodged by the mother of the petitioner vide Triveniganj P.S. Case No. 109 of 2020. Three persons from the side of the informant have received injuries; one out of which has been opined to be grievous in nature.
However, the aforesaid injury is not attributable
Patna High Court CR. MISC. No.15488 of 2021(2) dt.06-01-2022 2/2 to the petitioner. The petitioner and one Md. Anwar are also said to have been injured in the occurrence. Thus, in view of the background facts and taking into account that the petitioner himself has been injured in the occurrence, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate - 1st Supaul in connection with Triveniganj P.S. Case No. 106 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
