On 22.9.2014 at about 4 P.M.,Sudarshan Yadav and Shankar Paswan came at the house of the informant Rakesh Kumar Yadav, called his brother by his name whereupon the informant, his father Jageshwar and his brother Pankaj came out. Sudarshan enquired from them regarding the assault over his friend Sanjay Yadav, which was denied by the petitioner and on account thereof, Sudarshan fired causing injury over hand of Niranjan, brother of the informant.

The petitioner is not named in the F.I.R. However, from the order impugned, it is evident that apart from further statement of the informant, other co-accused, during the confessional statement, has also named the petitioner. As such, the petitioner Sanjay Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the
