2. The petitioners apprehend their arrest in a case registered for the offence under Sections 126(2), 115(2), 118, 352, 351(2), 3(5) of the Bhartiya Nyaya Sanhita.

3. Prosecution case, in brief, is that on 30-07-2024 at about 11 P.M., the informant was sleeping in his house, in the mean time, all the FIR named accused persons including petitioners armed with farsa, Garass, Tangi, entered in the house of informant, abused and thereafter, assaulted him, causing injury on his head and hand.

4. Learned counsel for the petitioners submits that both parties are Gotiyas and on a petty dispute, altercation took place between the parties. Allegation of assault is general and omnibus and there is no specific allegation of overt act against these petitioners. Petitioners claim clean antecedent.

5. Learned A.P.P. for the State has opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Akbarpur P.S. Case No. 271 of 2024, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
