Petitioners apprehend their arrest in a case registered for the offence punishable under sections 420, 467, 468, 471, 504/34 of the Indian Penal Code.

It is alleged that the land of informant was sold by petitioner no. 2 (Md. Umar) in favour of petitioner no. 1 (Satyanarayan Rai) by committing cheat and forgery with informant in collusion with the officials of Sub-Registrar, Sheohar.

It is submitted by the learned counsel for the petitioner that these petitioners have falsely been implicated in

Patna High Court CR. MISC. No. 6389 of 2023(2) dt.11-05-2023 2/2 this case due to previous enmity. Both parties are agnates and the land in question belongs to father of the petitioner and father of the informant have got no share. From perusal of the FIR, it is clear that it is a simple civil dispute among the family members, so no criminal case is made out against the petitioners. Petitioners claim clean antecedent. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheohar in connection with Sheohar P.S. Case No. 334 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
