2. The petitioner apprehends his arrest in connection with Belaganj P.S. Case No. 487 of 2024, registered for the offences punishable under Section 317(5) of the B.N.S., 2023 and sections 25(1-B) (a), 26, 35 and 25 of the Arms Act.
3. As per prosecution case, petitioner and other coaccused persons are alleged to be involved in the business of illegal arms and ammunition.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. He further submits that on the basis of confessional statement of apprehended co-accused namely Minta Devi, petitioner has been made accused in the present case. No
Patna High Court CR. MISC. No.5000 of 2025(2) dt.13-02-2025 2/2 incriminating materials has been recovered from the conscious possession of the petitioner. Petitioner bears clean antecedent.
5. Learned APP for the State has opposed the prayer for anticipatory bail of the petitioner.
6. Considering the aforesaid facts of the case and also considering the clean antecedent of the petitioner, the prayer for anticipatory bail of the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya, in connection with Belaganj P.S. Case No. 487 of 2024, subject to condition as laid down under Section 482 of the B.N.S.S.
