JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-376, 366, 366A, 323, 504/34 of the Indian Penal Code. Originally, the informant filed a complaint case, which was converted into police case and after investigation, police submitted final form in respect of the petitioner and some others but learned court below differed with the findings of the police and took cognizance for the offences. Moreover, the victim has already returned and her statement u/S 164 of the Cr. P.C. was recorded, in which, she stated that her marriage was, forcibly, solemnized with co-accused, Dheeraj Kumar by the petitioner and others. Co-accused, Dheeraj Kumar has already been granted

Patna High Court Cr.Misc. No.12226 of 2016 (2) dt.29-03-2016 2/2 privilege of bail by a coordinate bench of this court. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Palanwa P.S. Case No. 117 of 2012 to the satisfaction of Sri N. K. Priyadarshi, J.M.-Ist Class, Raxaul at Motihari, East Champaran.
