JUSTICE PARTHA SARTHY ORAL ORDER 02-07-2021 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Sakra P.S. Case no. 186 of 2020 registered under section 302 and other sections of the Indian Penal Code.
As per allegation in the F.I.R., it is stated by the informant that the informant side had questioned the accused Rupesh Kumar when he had injured Suresh Kumar in an accident with his motorcycle and had escaped. Thereafter it is stated that the fifteen named accused persons including Rupesh Kumar and the petitioner herein together with 10 unknown persons came and assaulted as a result of which Dharmendra Kumar died and others were also injured.
Patna High Court CR. MISC. No.14092 of 2021(2) dt.02-07-2021 2/2 It is submitted by learned counsel for the petitioner that the allegations as levelled in the petition are false and concocted. The petitioner has been falsely implicated in the case. The allegations are general and omnibus in nature. The petitioner is in custody since 6.6.2020.
The application for bail is opposed by learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the petitioner having remained in custody for over one year, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Sakra P.S. Case no.186 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-XII, East, Muzaffarpur.
