JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 13-12-2017 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.

The grievance of the petitioner in the instant case is that despite necessary document was forwarded by the Head Master to the District Education Officer but the District Education Officer is sitting tight over the matter. He is not taking any decision one way or the other.

He placed reliance on the order passed by this court dated 05.12.2017 whereby the writ application of similarly circumstanced petitioner was disposed of with a direction to the District Education Officer to take final decision within a period of

Patna High Court CWJC No.4646 of 2017 (2) dt.13-12-2017 2/2 60 days from the date of receipt/production of a copy of this order. Counsel for the petitioner submits that his case may also be disposed of in the similar terms.

Considering the similarity, the writ application is disposed of with a direction to respondent, District Education Officer, Gopalganj to take final decision for grant of promotion expeditiously preferably within a period of 60 days from the date of receipt/production of a copy of this order. It is made clear that this court has not expressed any opinion on the merit of the claim of the petitioner. It is for the District Education Officer to look into the claim of the petitioner and decide the same on the basis of material available on record. With the aforesaid, the writ application stands disposed of.
